Terms & Conditions

These are the Terms & Conditions (“T&C’s”) of Expedition Good Life bv, incorporated and registered in Belgium with company number 0780.406.768, whose registered office is at Rue de Jolimont 42, 5600 Philippeville (hereinafter: “Expedition Good Life”).

These T&C’s apply to all services offered by Expedition Good Life to professional customers (“Customer”).

The services of Expedition Good Life are aimed at providing expeditions, hiking tours, and workshops for the employees, contractors, or agents of the Customer. (hereinafter: “Service(s)”)

Expedition Good Life does not accept, and the Customer agrees, the applicability of the terms and conditions of the Customer. 

1. Quotation

To receive a quotation, the Customer needs to complete the sign-up form on the website or contact us via email at info@expeditiongoodlife.org.

The quotation is valid for a period of 30 calendar days. All prices are quoted in EUR and exclusive of VAT unless otherwise indicated.

The quotation includes details of the Services, such as the purpose, number of participants, date, location, price, etc. The number of participants is limited to the group size mentioned in the quotation. If the Customer wants to add additional participants, this will be subject to a new quotation.

Upon the written confirmation by the Customer of the acceptance of the quotation, the agreement between Expedition Good Life and the Customer is established.

2. Services

All Services will be executed as described in the quotation and for the group size as mentioned in the quotation.

The Customer is responsible for communicating the name (first name + last name, email address and phone number) of all participants to the Services as well as any dietary preferences of the participants, to Expedition Good Life.

Expedition Good Life may contact participants if necessary for additional questions regarding the Services.

The Customer understands and accepts that the participants will individually need to agree on the Statement of Consent as outlined in article 6.

3. Invoice & payment

The invoice for the Services will be sent to the Customer either before or after the execution of the Services.

The payment term is 14 days, unless otherwise indicated on the invoice.

Failure to pay an invoice on its due date results in an interest of 1% per month being owed without further proof of default as well as in a compensation for financial losses equal to 10% of the invoiced sum with a minimum of 150 EUR, in addition to any administrative collection and protest costs and the above-mentioned interests.

4. Cancellation or modification

In case of cancellation by the Customer 30 calendar days before the start of the Services, the Customer will receive a full refund and credit note.

If cancellation takes place between 30 and 14 calendar days in advance, 50% of the total fee will be charged. Cancellation within less than 14 days before the start date will result in a 100% charge. 
Any request for cancellation must be done in writing by sending an email to info@expeditiongoodlife.org.

Prior to the start of the Services, Expedition Good Life reserves the right to exclude a participant if there is a strong indication that he/she will be unable to participate based on their physical or medical condition. The Customer and the participant will be notified of the exclusion as soon as reasonably possible.

Expedition Good Life reserves the right to unilaterally terminate the agreement and exclude a participant from further participation if the participant behaves in such a way during the program that jeopardizes the safety of themselves and others, as specified in the Statement of Consent.

In the event of exclusion of a participant, whatever the reason for exclusion, the Customer is not entitled to a refund.

5. Force Majeure

Force majeure is an unforeseeable and unavoidable circumstance, not attributable to Expedition Good Life, which renders it impossible to fulfill its obligations, e.g. (but not limited to) natural disasters, strikes, blockades, facilitator(s) illness, riots, epidemic/pandemic, extreme weather conditions, machinery breakdown, fire, explosion,…)

In the event that the Services cannot proceed due to Force Majeure, Expedition Good Life reserves the right to postpone or reschedule it to a later date and/or venue, while maintaining the existing registrations, including the paid fee.

6. Statement of Consent

The Statement of Consent is a written document which must be accepted and signed by each participant to the Services. The Customer is responsible for informing all participants of this Statement of Consent.

The signing of the Statement of Consent by each participant is a prerequisite for the participation of the said participant to the Services.

7. Photo and video

Expedition Good Life is allowed to use photographs and video’s taken by the facilitators for (social) media, website and communication purposes. If the Customer or any of the participants does not agree, they must expressly notify us before the start of the Service.

8. Intellectual Property Rights

Our website, logos, texts, photos, and all our communications are protected by intellectual property rights owned either by us, our suppliers, or other rights holders. If course material is provided, it is subject to intellectual property rights.

9. Confidentiality and Privacy

Expedition Good Life undertakes to treat any business information of the Customer that may be considered confidential as confidential.

The approach, methodology or content of all of Expedition Good Life’s program’s is considered Confidential Information. The Customer nor any of the participants may disclose any Confidential Information to third parties without our prior written consent. In the event of a breach of this provision, a compensation of 5.000 EUR per violation shall be due.

Expedition Good Life bv, Rue de Jolimont 42, 5600 Philippeville is the Data Controller of the personal Data of the Customer. We will process all personal data in conformity with our Privacy Policy.

10. Liability and insurance

The Customer understands and accepts that the participation to certain Services may involve certain risks to the mental or physical health of the participants and that the access to the Services is limited to participants who are in good physical and mental condition.

The Customer is accountable for the actions of the participants during the execution of the Services. The Customer is liable for any damage caused, whether intentionally or due to negligence, and will be responsible for covering the costs of repair.

Neither Expedition Good Life nor the facilitators accept liability for any loss, damage, or theft of the participant’s property during or after the Services.

Expedition Good Life will execute the Services, which are considered as an obligation of means, as described in the quotation except in cases of Force Majeure.

Neither party shall be liable to the other for any indirect, consequential or special damages (all such terms include without limitation pure economic loss, reputation damage, loss of profits,…and similar damages).
Unless in case of intent or in case of mistakes which affects the life or physical integrity of the Customer or any of the participants, the liability of Expedition Good Life for any contractual or extracontractual liability arising under the agreement with the Customer shall be limited to direct damages and shall not exceed 50% of the fees which are payable for the event which caused the damage with a maximum coverage of the amount the insurance company of Expedition Good Life pays for the damage.

Expedition Good Life has concluded a professional liability insurance.

11. Applicable law and jurisdiction

Disputes arising from or relating to our agreements are governed by Belgian law.

In the event of a legal proceeding, only the Belgian courts of the judicial district where our registered office is located shall have jurisdiction.

12. Other provisions

These T&C’s constitute the entire agreement between the Customer and Expedition Good Life.

If any provision of these T&C’s is found to be unlawful, void or unenforceable for any reason, it shall be deemed separable from these T&C’s and shall not affect the validity and enforceability of the remaining provisions.
